What Is "Consent To Settle"? Individual insureds have the right to consent to settlement, so long as consent is not unreasonably withheld. This means that a claim may not be settled without consultation and agreement of the insured. An example of "unreasonable" withholding of consent would be if there were no competent expert in all of the United States who could support the position that the care at issue was appropriate, but the insured wanted to continue on with the defense. |
